TERMS & CONDITIONS + AI IMAGERY INDEMNITY AGREEMENT


These Terms & Conditions (“Agreement”) govern all services provided by Sable Media Productions (“the Photographer”) to the client, agent, or agency (“the Client”).


1. Services

The Photographer agrees to provide real estate photography, videography, and/or related media services as agreed upon at the time of booking. Services may include, but are not limited to, still photography, video, drone imagery, and digital enhancements.


2. Booking & Confirmation

All bookings must be made via the official booking system or agreed communication channels.

A booking is only confirmed once:

  • The requested date and time are accepted by the Photographer, and
  • The Client has agreed to these Terms & Conditions.

By proceeding with a booking, the Client automatically accepts this Agreement in full.


3. Payment Terms

  • Payment terms will be communicated at the time of booking.
  • Full payment may be required prior to delivery of final media unless otherwise agreed.
  • Late payments may result in delays in delivery or withholding of content.

4. Cancellations & Rescheduling

  • Cancellations must be made with reasonable notice.
  • Late cancellations or failure to provide access to the property may result in a cancellation fee.
  • The Photographer will make reasonable efforts to accommodate rescheduling but does not guarantee availability.


5. Property Readiness

The Client is responsible for ensuring that the property is fully prepared prior to the scheduled shoot time.

This includes:

  • Cleaning and staging
  • Removal of unwanted items
  • Ensuring all lights are working
  • Securing pets and occupants

The Photographer is not responsible for staging, moving furniture, or cleaning the property.


6. Access & Time on Site

The Client must ensure that:

  • The Photographer has full access to the property at the scheduled time
  • Any delays caused by the Client may reduce shooting time or incur additional fees


7. Turnaround Time

Delivery timelines will be communicated at the time of booking.

Typical turnaround times may vary depending on:

  • Scope of the project
  • Editing requirements
  • Add-ons such as rush delivery

Delays caused by factors beyond the Photographer’s control may occur and will be communicated where possible.


8. Editing & Creative Control

The Photographer retains full creative control over:

  • Composition
  • Editing style
  • Image selection

Final delivered content reflects the Photographer’s professional judgment and brand style.


9. Revisions & Additional Edits

  • Basic edits are included as part of the service
  • Additional revisions or re-edits may incur extra charges
  • Requests for major changes after delivery may be quoted separately


10. AI Imagery & Digital Enhancement

The Client acknowledges and agrees that the Photographer may, at their sole discretion, make use of artificial intelligence (AI), virtual staging, image compositing, retouching, or other digital enhancement techniques in the creation and delivery of content.

All such media is created strictly for marketing and promotional purposes only and may not reflect the exact, current, or factual condition of the property.


11. No Warranty or Representation

The Photographer makes no warranties or representations, express or implied, regarding the accuracy, completeness, or authenticity of any images or media, including those enhanced or generated using AI or other digital methods.


12. Client Responsibility

The Client accepts full responsibility for:

  • Reviewing and approving all delivered content prior to use
  • Ensuring compliance with all applicable laws, regulations, and advertising standards
  • Any use, publication, or distribution of the media

This includes any content modified after delivery by the Client or any third party.


13. Indemnity

The Client agrees to indemnify, defend, and hold harmless the Photographer, its owners, employees, and contractors from and against any and all claims, liabilities, damages, losses, legal actions, or expenses (including legal fees) arising out of or related to:

  • The use, publication, or distribution of any images or media supplied;
  • Any alleged misrepresentation of the property;
  • Any reliance placed on AI-generated or digitally altered content;
  • Any modifications made to the images after delivery;
  • Any breach of applicable laws or advertising regulations by the Client.


14. Usage Rights

  • The Client is granted a non-exclusive license to use the delivered media for marketing and promotional purposes related to the property
  • Images may not be sold, transferred, or used for commercial resale without written consent
  • The Photographer retains full copyright of all media produced


15. Marketing & Portfolio Use

The Photographer reserves the right to use any images or media for portfolio, marketing, social media, and promotional purposes unless otherwise agreed in writing prior to the shoot.


16. Limitation of Liability

While every effort is made to deliver high-quality services, the Photographer shall not be held liable for:

  • Missed shots due to property conditions or access limitations
  • Technical failures beyond reasonable control
  • Any indirect or consequential losses

Liability is limited to the total amount paid for the services rendered.


17. Force Majeure

The Photographer shall not be held liable for failure to perform due to circumstances beyond control, including but not limited to:

  • Weather conditions
  • Equipment failure
  • Illness or emergencies
  • Government restrictions


18. Acceptance of Terms

By booking, confirming, or making payment for services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms & Conditions and Indemnity Agreement in full.
